Digital Product License Agreement

This Digital Product License Agreement ("Agreement") governs your purchase, access to, and use of all digital products, courses, assessments, downloadable resources, AI-powered experiences, and educational materials offered by Flourish In Color ("Company," "we," "our," or "us").

By purchasing, downloading, accessing, or using any Flourish In Color digital product, you agree to the terms below.

1. License Granted

When you purchase a Flourish In Color product, you are purchasing a limited, non-exclusive, non-transferable, revocable license for your personal use only.

You do not acquire ownership of the product or any intellectual property contained within it.

2. Personal Use Only

Unless expressly stated otherwise in writing, every purchase is licensed solely for your individual use.

You may:

• Download your purchased materials.

• Print copies for your personal use.

• Save files on your personal devices.

• Complete worksheets for yourself.

• Access purchased courses for your own learning.

 

3. Prohibited Uses

Without prior written permission, you may NOT:

• Modify our materials and present them as your own.

• Remove copyright notices or trademarks.

• Use our materials to create competing products.

• Record, duplicate, or distribute course videos or coaching sessions.

• Upload our content into another course, membership, or coaching program.

 

4. Coaches, Therapists, Consultants & Organizations

Purchasing a Flourish In Color product does not grant permission to:

• use our worksheets with clients,

• include our materials in coaching packages,

• teach our frameworks,

• distribute our assessments,

• reproduce our exercises,

• incorporate our resources into employee training,

• use our materials in schools, organizations, nonprofits, churches, or businesses.

Commercial licensing is required for these uses.

5. AI and Machine Learning Restrictions

To protect the originality of our intellectual property, you may not:

• upload Flourish In Color materials into AI systems for redistribution,

• use our content to train artificial intelligence models,

• create derivative AI products based primarily on our materials,

• scrape, harvest, or reproduce our content using automated systems,

• generate competing products using our proprietary frameworks.

Limited personal use inside AI tools (for example, asking an AI assistant to summarize your own purchased workbook for your personal understanding) is permitted, provided the content is not redistributed or used commercially.

 

6. Proprietary Frameworks

The following are proprietary intellectual property of Flourish In Color and may not be reproduced, copied, taught, or commercially distributed without written permission, including but not limited to:

• The Girl of My Dreams™

• The Becoming Statement™

• The Gap Map™

• Flourish In Color™

• Any accompanying worksheets, graphics, assessments, prompts, reports, methodologies, exercises, videos, or future frameworks developed by Flourish In Color.

 

7. AI-Powered Assessments & Reports

Some products may generate personalized reports using artificial intelligence.

These reports are created exclusively for the purchaser.

You may save or print your report for your own use.

You may not:

• reproduce report templates,

• sell generated reports,

• use reports with clients,

• integrate reports into another platform,

• redistribute reports commercially.

 

8. Copyright

All content remains the exclusive property of Flourish In Color unless otherwise stated.

This includes:

• text

• graphics

• branding

• videos

• audio

• prompts

• assessments

• worksheets

• templates

• digital downloads

• AI-generated reports

• software experiences

• educational materials

These works are protected under United States copyright law and international copyright treaties.

 

9. Intellectual Property Enforcement

We actively protect our intellectual property.

If we determine that our products have been copied, shared, reproduced, redistributed, commercially used, or otherwise used outside the scope of this license, we reserve the right to pursue appropriate remedies available under applicable law.

These remedies may include:

• immediate termination of access,

• revocation of licenses,

• invoices for appropriate commercial licensing fees,

• copyright enforcement actions,

• injunctive relief,

• recovery of damages,

• attorneys' fees and legal costs where permitted by law.

Unauthorized use does not create any ownership rights in the user.

 

10. No Transfer of Ownership

Purchasing a digital product does not transfer ownership of any copyrights, trademarks, proprietary methodologies, or intellectual property.

Ownership remains exclusively with Flourish In Color.

 

11. Refunds

Refund eligibility is governed by the refund policy associated with the specific product purchased.

Because digital products are immediately accessible, some products may not be eligible for refunds once access has been granted.

 

12. Termination

We reserve the right to revoke access to any product without refund if we determine this Agreement has been violated.

 

13. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Texas, without regard to conflict of law principles.
